AceToon User Agreement

1. Agreement to Terms

Welcome to AceToon! These Terms of Service ("Agreement") establish a legally binding contract between you ("User") and AceToon ("we," "us," or "our"). By accessing our mobile application, website, or any associated digital products (collectively, the "Services"), you signify your acceptance of this Agreement and our Privacy Policy.

If you are utilizing AceToon on behalf of an entity, that entity agrees to these terms and undertakes to indemnify AceToon against any liabilities arising from its use of the Services.

2. User Eligibility

By engaging with AceToon, you affirm that:

• You are at least 18 years old (or have reached the age of majority in your jurisdiction), or possess valid parental/guardian consent.
• You are a minimum of 13 years old. AceToon is not designed for individuals under 13. If you are below 13, please refrain from using the Application.

3. Service Description

AceToon offers a platform for the viewing, subscription, and interaction with digital comic content and related materials.

• External Links: Our Services may include links to third-party websites not under AceToon's control. We disclaim responsibility for the content or privacy practices of these external parties.
• Service Modifications: We retain the unilateral right to update, alter, or discontinue any aspect of our Services at our sole discretion, without prior notification.

4. Account Management

Access to certain premium features necessitates the creation of an AceToon account.

• Account Security: You bear full responsibility for safeguarding your password and for all activities conducted under your account.
• Information Accuracy: You are required to furnish accurate and complete information during the registration process.
• Reporting Unauthorized Use: Promptly inform us at horacio@weaversstoreinc.sbs if you suspect any security breach or unauthorized access to your account.

5. Acceptable Use and Restrictions

AceToon grants you a limited, non-exclusive license to utilize the Services, contingent upon your adherence to the following:

• Prohibition on Modifications: You are forbidden from altering or tampering with any component of the Application or its underlying code.
• Automated Access Restriction: The deployment of "bots," "spiders," or any automated systems for data scraping or artificial inflation of metrics is strictly prohibited.
• Compliance with Laws: Your use of the Application must conform to all applicable local and international laws.
• No Data Harvesting: The collection of personally identifiable information belonging to other users is expressly forbidden.

6. User-Generated Content Guidelines

Should the Application permit you to submit content (such as comments, images, or narratives):

• Content Responsibility: You are exclusively accountable for the content you post and the repercussions of its dissemination.
• Content Ownership: You warrant that you own or possess the requisite rights to any content you submit.
• Prohibited Content: You may not post content that is unlawful, infringes upon intellectual property rights, or violates the rights of others.
• License to AceToon: By submitting content, you grant AceToon a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your content in connection with the Services.

7. Intellectual Property Rights

All original content within AceToon, including but not limited to logos, software, and proprietary graphics, is either owned by or licensed to AceToon. Unauthorized use of our trademarks or copyrighted material without explicit written consent is prohibited.

8. Payments and Refund Policy

• In-App Purchases: Transactions for virtual currency or subscriptions are facilitated through third-party app stores (Apple/Google).
• Refunds: Generally, all purchases are considered final and non-refundable, unless mandated by law or the policies of the respective app store.

9. Termination of Access

We reserve the right to suspend or terminate your account and access to the Services at any time, with or without cause, particularly in instances of Agreement violations.

10. Disclaimers and Liability Limitations

• "As Is" Provision: AceToon is provided without any warranties, whether express or implied.
• Limitation of Liability: To the fullest extent permissible by law, AceToon shall not be liable for any indirect, incidental, or consequential damages stemming from your use of the Application.

11. Governing Law

This Agreement shall be interpreted and governed by the laws of the United States, without reference to its conflict of law principles.
